    IRS Taxes after filing Chapter 13

    Hi All-

    We have to submit our tax returns to the Trustee each year. For 2008, we will owe about $4,000. Our trustee said we cannot incur debt over $250. We are 2 years into our plan.

    Anyone ever have their case dismissed due to new takes owed? I would rather make voluntary payments to the IRS than go before the trustee and have him comb through our expenses again!!

      Taxes and new debt acquired after filing are your own responsibility. We owed $1500 for tax year 2004 due to monies received from a former employer for unpaid sick and vacation time from the company's BK two years prior, increasing taxes for us that year. Our attorney advised us to contact the IRS for a payment schedule which we did and our Trustee was informed. We agreed on a monthly payment we could afford ($50) to pay to the IRS and when we refinanced at the end of our Plan, we paid off the balance that was owing at that time.

        We owe 941 employee withholding taxes for 2008. We filed this year and have made arrangments to make a payment to the IRS electronially every week so we will not fall behind.
