I understand that some get their full or partial refund while in a Chapter 13 depending on the state and the trustee. My question is this- I included some taxes (2002) in my Chapter 13. I do expect a refund this year, in the past years my refund has been applied to what I owed. Will I still get the refund if I filed on taxes? I know this sounds confusing. I called the IRS and they said they have it noted that I have filed Chapter 13 and my taxes are classified as "uncollectable" but that didn't tell me if I would receive my refund.

If you included your taxes in your Chapter 13, you should receive a refund for 2008 if one is due; the taxes you included in your Chapter 13 for any prior year(s) are included in your Plan and being paid to the IRS by your Trustee during the course of your Plan. However, whether or not you can keep that refund will be determined by your attorney/trustee._________________________________________
