    Sherriff's sale keeps being delayed. . .

    Our last payment on our primary loan (80%) was in May and our last payment for our HELOC was June and our house was first to be put up for auction Dec. 6th, but then the sale moved to Jan. 16th, and now it's being postponed yet again until the middle of Feb.

    Anyone have this happen? I have no idea what the deal is.

    We moved out of the house in the latter part of May and into a rental (and did so before my husband's credit tanked) and the house has now been empty for 10 1/2 months.

    Our key to the front door still works.

    Any thoughts on this?

    This sometimes happens. When I've seen Sheriff Sales delayed (I check our Sheriif's site frequently), the delay is usually because of a reappraisment.

      Why on earth did you move out? You just wasted 10 months of rent that you could have kept in your pocket all that time. Why not wait until the sheriff says to leave and then find a place to move to?

      That's what I want to do. For us, 10 months of not paying PITI = $11,000 in my pocket! That could be used to move to the new place, pay first, last, security, deposits and the moving truck.

      Why do people move out early? What is the purpose? Am I missing something because this is all coming for me soon since I am about 90 days past due.

        With a BK and a foreclosure, it may be difficult to get approved for a rental. It all depends on who your working with.............so............when we find the right place for the family, AND a landlord/homeowner/property manager willing to work with us and overlook the BK and foreclosure, you've gotta act on it. It's the uncertainty of "Where will we live" when the Sheriff comes knocking that makes us act so quickly.

          I can't afford to move. It will take a good $5,000 to $6,000 in order to pull that off between first, last, security and moving expenses. In order for me to save up that kind of cash, I need to finish paying the lawyer and then I need to stay in this house rent-free for many, many months so I can bank all of that cash. I have no choice but to wait until after the BK is filed and done. I need the "time" of rent-free living to act as a buffer to be able to move, otherwise I'll have to leave 95% of my possessions here. We have a 3 bedroom house filled with stuff. It's not worth anything to sell, but it would cost a fortune to buy it all new again. It's cheaper to pay to move it and not have to replace it.

          We won't be moving to the same neighborhood. I will most likely be moving a good 100-1100 miles away from where I am living now. We are undecided. We have so many cities in mind... Orlando, FL, Atlanta, GA, Cary, NC... possibly Virginia or Maryland. We don't know. We've been trying to research jobs and also talk to friends and family who all live in those areas.

              Me too. It is hard enough starting over with nothing (Fl exemptions)...why not save up while you can!

                So how much do we get to keep if we file Ch. 7 and include the house? We'll be filing jointly. My wife keeps complaining that she doesn't want to lose our 50" HDTV that we financed through Best Buy in 2006. It's nearly paid off, but we added a lot more charged on the card buying a PS3 and financed a speaker installation for the ceiling and walls.

                  We didn't waste 10 months' worth of rent because we found a rental in a respectable neighborhood that is located by the school my kids already had attended and almost all the houses here are owned, so finding a rental was a huge breakthrough in our plans to begin a new life and keep our kids stable. We had enough to pay first, last and damage and live in a clean, safe neighborhood and we were not about to blow that oportunity by SQUATTING in our pre-forclosure home and taking advantage of the situation.

                  Best of luck to you. You make the decision that is best for you! I'm proud to say that my husband and I made an excellent decision and based our choice on what worked for us, not what other people thought we should do.

                    Money is too hard to come by. I will squat as long as I possibly can. I am thinking of moving to Virginia which will cost quite a bit of money to relocate. There's no way I could just pack up and move right after filing bankruptcy. It will cost a fortune for moving and then to find somebody who will rent us an affordable house with a bankruptcy and a foreclosure will be very tough.
