    Yes, found nice attorney and now I begin.

    In two weeks I see my attorney and he sent me all the paperwork in hopes I'll be ready to file that day, or as close as possible. He was nice and helpfull unlike the first I called. I've read this a few times, but it is stupid to pay any CC bills correct? I did a $300 dollar check to help with the mortgage, is that a problem or should I send them $300.

    I have a motorcycle that I couldn't sell and it is worth 3K. What is the process of the trustee taking it? He can have it. I want to be done and free and hope I never am extended credit again. It's like a drug and I need no help in using it.

    If your going to file, no don't pay the credit card bills. They are going into bankruptcy with you so there is no need to pay. Also depends on your state about the motorcycle, do you owe on it, is it a secured creditor if you do? If you own it out right you may be able to exempt it depending on your state, i.e. if you have something called a wildcard exemption. As far as the $300 check, I don't quite follow, is it your mortgage or were you helping someone else out?

      I own the bike and I was short $300, so I wrote a CC check.

        hmm not sure about the 300 CC check, I do know that if you use your credit cards excessively up to the date of filing it is considered fraud, I wouldn't think that this 300 would be considered that but I am not a lawyer so not sure, and the bike what state are you in? Check the exemption list and see what your allowed for vehicle or if you get a wildcard exemption?

            Just last month, and very small charges here and there. Very little use in the last 6 months. I knew money was tight, but was trying not to file at all, so no intent to defraud, if that matters.

              At the very worst you would probably have to pay back the $300, but it seems to small for it to be disputed.
