What is a FINAL REPORT AND ACCOUNT BY TRUSTEE

I just got this in the mail...

NOTICE OF FILING OF FINAL REPORT AND ACCOUNT BY TRUSTEE


Notice is further given that unless an objection is filed by the United States Trustee or a party in interest within
30 days of service of this notice, the Court may declare that the bankruptcy estate has been fully administered,
and that the Trustee should be discharged and further liability on said Trustee's bond with respect to this case
can be terminated.



This was apparantly sent out to all my creditors - again - even though my BK was discharged on Dec 1, 2008.

The Case Summary in Pacer shows that the case was discharged - 12/1/08, but the pending status is showing "Awaiting closing"

Is this common?? Can one of my old creditors re-file or something? Should I be worried (I am) or is this part of the process?

And here I thought I was DONE!

You are done! This is just paperwork and formality to be sure that everyone got paid what they were supposed to, and no one got paid more, or anything like that. Once they verify all this, your case will be closed.

To give you an idea....our BK was discharged at the end of August in 2006. It was closed in early January 2007.

I just had the same notice show up on pacer but my bankruptcy has NOT been discharged as of yet. My case was "closed" on 12/11/08. All of your creditors have 30 days to object and if none do, then you will be discharged and your case closed. I am counting down my days to March 2, 2009.

rrockinggramma - Congrats on your plan being "closed". My question is - why would creditors object after you complete paying into your plan? What kind of things would they object to?

anyone know how long after you get the Final Accouting notice that it gets closed?

I suspect every district handles it differently. In Michigan, your case is discharged after the 30 day period for objections and if ALL of the final disbursement checks have cleared. Perhaps not all of your stuff has cleared. Have you checked out your case on the data center or 13network to see where you are?

Typically 2-3 months, but a lot depends on how complex your case was. Also right now the bk courts and Ch 13 trustees are overwhelmed with cases to administer - that's likely slowing things down a bit right now as well.

It's fine to call or email your lawyer and ask him/her to contact your trustee to find out how things are going with the audit and what the anticipated finish date might be.
