Can't File?

Ok. My divorce lawyer who "won't" send me an itemized statement so I know how much of my retainer he used, also isn't following up now on sending me my bankruptcy papers. I more than got the feeling they don't wish to help me out with this. He didn't hardly do anything and I had to get my dad to go in with me just to finally get him to do his job. But I had given this man the last of my extra cash so I had no other money to go to another lawyer.

My time is running out. This lawyer wanted me to refinance the house before BK to get my husbands name off of the loan. My ex quit claimed the deed over to me in the divorce. Because the ex paid let the house get 3 months behind on payments on 3 seperate occasions in the last year, the credit is so bad that I can't get it refinanced now, at least not for another 5 months.

Since I can't get my lawyer to help me and I can't afford another one, I am considering trying it on my own. IM DESPERATE! Does anyone know if I can still file BK even in the ex's name is still on the loan? I am going to have to sell it after the BK because they appraised the house to refinance and now the house payment went up by more than 200 a month as well. I don't have the money for any "major" problems that might happen and have no help to fix it if it does.

PLEASE, ANYONE! Can you give me any insight? I am so desperate, I don't know what else to do but try this on my own!

Why did the payment go up? That doesn't make any since?
I don't know much about BK, but you can look into the www.form7.com software. It was very easy to use, but I had an easy case (my mom's) I suggest doing some searching here to see if anyone has been in your shoes with a similar situation and used the form7 software.

I would also do something about that attorney of yours. That sucks he's taking advantage of you like that. I would threaten them with turning them into the BBB if they don't straighten up!
