Does anyone know if a lender is required to submit a motion for release from stay to enforce an assignment of rents on a rental property? Basically what has happened is I filed Ch 7 in November. About 1 week later my tenant received a letter from the lender saying to send their rent payments directly to them. I'm thinking it may have crossed in the mail and possibly sent prior to them actually knowing I filed. But I need to know if they can still enforce it prior to the stay being lifted.
