Hi All, I have read and researched previous info on discharging old tax debt BUT am confused as to what steps I and or attorney should take to make this happen.
Filed Ch. 7, no asset one week ago. Attorney properly shows tax debt on sch. E - "priority unsecured." There is no lein, etc. and the taxes are from 2002. Never made payment arraingment etc.
Attorney says I need to "negotiate" with IRS after discharge??? When I talk to IRS to make payment arraingment on valid taxes I owe for year 2006 of $800, they say I must include the old taxes also? This negotiation would be done after the discharge.
So what am I missing or what do I do to make sure old taxes go away...
PLEASE, any help would be appreciated.
Short version of rules I found below:
"If the income tax debt meets all five of these rules, then the tax debt is dischargeable in Chapter 7 and Chapter 13 bankruptcy petitions.
-The due date for filing a tax return is at least three years ago.
-The tax return was filed at least two years ago.
-The tax assessment is at least 240 days old.
-The tax return was not fraudulent.
-The taxpayer is not guilty of tax evasion."
