    Creditors Wanting to Remove Stay

    My husband and I live in Ohio and have been in Chapter 13 since last February. We have become 3 months behind in our mortgage payment, and now the lender wants to remove the stay. We have readjusted our budget and have increased the earnings coming in. How assured can we be that our attorney can come to an agreement with our lender so that we can keep our home?

    This is difficult as who knows the future? However, they really don’t want your house. The mortgage company wants your money and every vacant house is a liability in that it can be spoiled by derelicts and age. I would suggest go to the company and tell them you need a mortgage rewrite to lower payment. Do this under your lawyer of course but, they sure don’t need another house. ‘Hub
