I just got off the phone with my lawyer.He told me I am 2500 over the means test due to a bonus I received last August.He said that I have the option of waiting until the beginning of March to file so that my August income wouldnt come into play.I'm just so overwhelmed I really am anxious to get my case filed and start my fresh start.

The beginning of March is less than 3 weeks away. It will worth it to you to wait those 3 weeks for the peace of mind it will bring you. It could be much worse. What if you had to wait 3 months? Or more? A lot of people do. I had to wait about 6 months to file because of income issues. But your time will get here soon enough. Hang on!Filed Ch. 7 (no asset): 12/30/2008

I agree that 3 weeks is a short time to wait for that extra income to fall off in your six month look back. Remember, the BK is a snapshot in time - make the most of it!Filed CH 7 9/30/2008

As others have said, it's worth it to wait the three weeks. 'Hub and I get a yearly stipend from a Trust in January. Our attorney would not even begin to file until August 1.
Of course, after that, we had to practically kick her rear end to get her motivated to file at all by the end of December 2007 before January came and we would have to wait six more months. We did not have a very good attorney.

I wanted to file last Aug. My att. said to wait til 09 the later the better. Well I went to see him on Monday and now he wants me to wait some more. He said...they're just calling you right (yea every 2 min.). Nothing else is happening to you so I suggest to wait as long as possible to get more time between last Bal Trans. (they were last June but they were huge). Also I only made 3 payments to 2 of the cards that had major Bal Trans. He spent 2 hours with me going over everything and wouldnt take a penny from me yet. So far my free consultation was 2 hours and Monday was 2 hours..not one red cent. What an amazing man. Even tho I'll wait and wait and wait, at least I trust this guy and feel comfortable with him. My first attorney I fired he would of landed me in the pokie with his bad advice.
I told my att. about this site and how much I've learned, but he says wait so wait I will..Damn...so you only have to wait 3 weeks...Lucky You !!

We quit paying bills the end of Sept. and we won't file until after we get our refund. It will definitely be worth it, as his 401k cashout will drop off the lookback, and it will all be from his current job, which he took a paycut for. This is one of those things where the outcome is worth the wait.
And most def. be on your lawyer like flies on you know what when you are ready! Good luck to you.

We've been waiting -like I said- since beginning of Dec- maybe even November for an August withdrawal from 401k to fall off.
