Everything went well with our 341 meeting. No creditors show up and our trustee is the best! There are I think 10 questions asked and we pretty much breeze thru it. We are a NO ASSET case so we are just anxiously waiting for the discharge. The room is packed with people though. I heard all sorts of situation in the room and I am rather surprise some people are just not doing their homework before filing. Granted I found this site after we filed but our lawyer was pretty much into our stuff so that was a good thing. I am also surprised that others are in their 4th time filing bankruptcy! I liked our trustee because he will actually call out lawyers with clients filing more than once to counsel them not to abuse the system. Now that we wait, do we have to move out right away or wait till we get a foreclosure notice? Our lawyer told us to live free for a while till we get a notice in the mail. Im not too comfortable about that knowing I am not sure how many days they are going to give us to move out. Anyone in here who did the same thing? Thank you everyone for the help.

This is a once in a lifetime opportunity to save while you do not have to pay rent or a mortgage. Take advantage of it (it actually is better for the property to have someone care for it - mow the lawn, have running water and lights etc).
You will get notified when the final judgement is issued and the sale set. You have months. Ask your attorney for an approximation.Filed CH 7 9/30/2008

I am excited that we can live and not worry about the mortage for awhile but the lawyer is not sure till when though. He just said to wait for the notice of foreclosure. I am concern that we wont be able to find a place because of our credit scored.We have an apartment we were pre approved since December but that credit check is only good till June 2. We haven't given then the actual date as far as moving in but we are on hold till around April and first week of June. The problem is that, if we do not move in before June 2 that they say they might run our credit again. Im scared they might change their mind as far as approving us.Filed: Jan 6, 2009

Which state do you live in? I know that in FL for example it takes 3 -4 months from scheduled foreclosure auction date til eviction notice. But then you get only short notice for 3-5 days prior to eviction.
If some landlord already reviewed your credit and approved you and offered an affordable rent, I would go with that offer and sleep well at night.
You can stay in the house for few months and save money, but then you will end up putting this money for extra deposit on a rental contract and having hard time convincing landlord that you can pay rent in time after they see your recent bankruptcy record.

So move to the rental on June 1 then. That gives you almost 4 months of no rent or mortgage and doesn't jeopardize your rental situation. We are in VA. We just got a call from the apartment and they do have one that is open around last week of april, and we can move in the last may 1. That is good new for us. I just wanted to be reassured that foreclosure process is slower and that we can move out before all these notices come out.Filed: Jan 6, 2009
