We are getting ready to file BK and I just wanted to say I really feel this forum has helped us so much.
I have been reading here for almost a year ... I won't say lurking because I have been posting - but I pretty much knew BK was coming.... then my DH was layed off (he's back at work now) and just this week, my employer issued an across the board pay cut.
We are over still the median - and finally saw an attorney a couple weeks ago. He was very nice - but he asked about a half dozen questions and said "You'll qualify for a 7." It seemed to me that he was making it waaay too easy and, even though that was what I wanted to hear... I knew (based on what I learned here) that he didn't have enough info to make that determination. It was like someone saying "I love you" on a first date. You want to believe it... but you know you can't.
My DH was sold on the atty... To him it was a done deal, but not to me...
So I made another appt. w/ an attorney who was a trustee... He asked me every question I thought he would ... and then he asked more questions... and he said he was "optimistic" we would qualify for a 7. I felt much more comfortable with him because he really seemed to be searching for any possible issues... I asked him questions I already knew the answers to (or thought I did) and he answered exactly as I thought I would.
The biggest discrepancy between the 2 atty's was - atty #1 said we could file immediately. I felt strongly that we need to wait until at least March 1 - since our income in Feb was HALF what it was in August... atty #2 said to wait til March if we could... Which I really think is the best way to go.
This is still very stressful, but knowledge is power and I am so glad I have a good understanding of how this process works.
So thanks to everyone! As soon as we get our tax refund (any day) we will pay the atty. and get the ball rolling.
