    Nervous about inevitable collection, mixed posts.

    I keep finding conflicting information on this subject.

    Is it a good idea to tell original creditors and collection agencies that you are going to file a BK, even though it will be several months before you actually will?

    If you could also, if you have any experience with this, list how long it took them to finally attempt to sue you, and the type of answers you gave to collectors when they did call previous to suing you.


    For my wife its already too late, I have told all of the wifes creditors of our intent to file, and so far, since last payments in Oct/Nov of last year, nothing yet, not even phone calls.

    For me however, the small amount of credit card debt that I have, I havent got any calls yet, I stopped last month paying, but I could change my tactics.

    I already retained an attorney, and plan on a Ch.13 filing in August/September of this year.

    Also, would they rather just put a lien on my house rather than go for the garnishment?

    If you tell the creditor you are going to file, they might sell the loan. This just might make it harder to discharge the debt.


    As for sueing, if you are working, you probably got a greater chance of getting sued then if you are not working. Same goes if you own a house versus rent.


    As far as putting a lien on your house or garnishering your wage, that is a toss up. If they think you can pay by wage garnishment, they probably will go that route. If you change jobs a lot, they probably will go with a lien.

      I had one joker tell me he wanted my Social Security Disability check. I told him to put it in writing and he refused. I didn't tell him but I don't get my social Security check. It already goes to another person. When I got hurt, I was a mess and Social Security decided another person would receive and dispense to me, when I need it, the contents of my Social Security check.

        I wouldn't tell them. I filed because I was sued and got a judgement. As for the time it took them to sue me, for me it took years. I had old debts dated back 5 or 6 years, so for me it wasn't as soon as I defaulted, it took some time. But I would not tell them you are going to or thinking of filing.
