In april 2001 my husband and i decided he would file for BK 13
because he had been laid off at his job, well he went and spoke to an attorney paid him a 60.00$ filing fee,

and a few days after that he got a call for a job so we decided we didnt need to do the Bk,I just let it go becasue I assumed that if we didnt go to the Bk proceedings that would be the end of it,it was dismissed june 2001

well about a year after that we got a copy of our credit reports and what do ya know there is the dismissed bk.

My question is, Is there anyway for us to have the courts reverse this decision?

Could I file an appeal or something because this is Sooooo wrong now we are going to have to deal with this for the rest of our lifes for something that was over in 2 months ,not to mention we didnt even pay any money into this ,it didnt even get that far.

As far as I know the plan wasnt even approved because my husband didnt show up for the hearing.so how could it be dismissed if it wasnt approved?

Please, any help would be greatly appreciated.

unfortunately, the facts are that you and your husband did file a BK and it was dismissed. It will be on your credit report for 10 years. There is no legal way to get that off your credit report because it is a fact. :( :(
