My attorney office is SOOO frustrating!!!
We filed chapter 13 back in October. In January my DH income was cut to 1/4 of what we need to bring in to pay everything. In February it went back up to about 1/2 of what we need to pay everything. Needless to say, we havent been able to pay our mortage.
I contacted my attorney office 3 weeks ago and faxed in pay stubs to see if we qualify to convert to a chapter 7. The attorney's assistant DOES NOT LISTEN!!! I cant tell you HOW MANY TIMES I have told her over the last 3 weeks that WE DO NOT have the $ to come current on the mortgage. EVERY SINGLE TIME she says 'well according the budget you do'. ummmm, if everything worked out in reallity as they do on paper...well, that would be great. grrr...
I finally called this week and told her I was really frustrated that I wasnt getting any answers from them and it has been 3 weeks. She continued to talk as though we can afford to keep the house, no matter how many times I told her we cant!
anyhow, I finally told her I just needed to know if we qualify for a 7. she couldnt seem to give me a straight answer. She finally told me to figure out what it would cost for rent.....IF we choose to give up the house .....
It looks like rent for a 4 bedroom house is going to run about $2000. BUT, what about the allowable amount? how does this work? she never mentioned anything about that! All she said was make sure it isnt more than your current mortgage payment.
I dont understand how this works! could someone please explain it to me, because she doesnt seem to be able to!
I'm so tempted to find a new attorney, but I dont know WHO, or HOW to find someone good! This one was referred by friends that didnt have these problems, but they filed 10 years ago
