    Car never reaffirmed

    Ok, I wrote about this a month ago. My auto company is still reporting our car as Including in Bankruptcy. I called my attorney again and the office staff said "yeah it wasn't filed" like it was no big deal. They don't know what happened. Last time they said it was the auto company that didn't file it properly.

    So I asked if it wasn't filed then can it be filed now? She said the case would have to be reopened. OMG. What a pain in the ass.

    I hate the fact that we are paying a car every month and that its not been reported.
    8/5/08 - Filed Chapter 7
    9/10/08 - 341 Meeting - It went great
    11/10/08 - Last day for Objections
    11/12/08 - Discharged & Closed!

    Though I didn't affirm, I continued my car payments hoping for them to report. Big fat nada...so I turned in the car and bought a cheapy @ stupid high interest; but at least it reports to all three. Call up the loan reps and get rid of it, since obviously its not helping your credit repair journey.

      I have heard - though not sure it's true - that sometimes they will report your payments if you ask nicely.

      I am making payments after my ride-through because I like the car, I bought a repair warranty with it, and if I were to buy another car I would not get the great interest rate I got on this one (one year before my bk).

      It's weird, though, it does show that I'm making payments, on the little graph that shows monthly payments, on Experian and/or TU, I forget which. But then in the other part above that it says "included in Ch. 7 bankruptcy". For all practical purposes it WAS included in the bankruptcy. In a ride through you are not responsible for the debt any longer - only if you keep the car. But as soon as you walk away from it, you get no black mark on your credit report for doing so, because it's already down on your report as your not really owing on it.
