I received copies of all of the documents my attorney filed on my behalf last Thursday in yesterday's mail. By the time I got home from work it was too late to call my attorney's office to ask about this. On the first page of my Voluntary Petition, under "Statistical/Administrative Information," my attorney checked the box "Debtor estimates that funds will be available for distribution to unsecured creditors." I am a no asset case and it even says that when I checked Pacer. It seems to me that he should have checked the box that reads "Debtor estimates that, after any exempt property is excluded and administrative expenses paid, there will be no funds available for distribution to unsecured creditors." Right?
Is this going to cause a problem? I would think that he could file an amendment to the petition to correct this error. I didn't notice this when I went into his office to sign the paperwork last week, as his associate didn't go through everything with me line by line. What worries me is that I have a decent size sum money in an account that is exempt (personal injury lawsuit settlement) and I don't want my trustee trying to get his hands on it.
