Garnishment? How long before they do it?

I have income and am paying, but how long do I have, before the cc companies may try garnishment?:(

They have to get a judgement first. Other than that, all I can say is 'it depends'.

DH had a judgement back in '00. It led to a garnishment in Aug. '05. But, he wasn't working for alot of that time-worked for my brother for cash, and was a SAHD for a while. He had been working since Feb. '04 though (had worked for this same company for a stretch from '01-02, and for a few months in '03 also.) My guess is this creditor has someone who periodically checks out the judgements to see if there is anything they can go after.

It all depends on how aggressive they want to be!! We had to go to court on March 23 for a judgment on medical bill from one of my surgeries. They sent a summons to us and said they were suing for over $1300!! I was floored.
With the summons they include an account log of all my insurance payment’s and some of my co-pays. On THEIR paper work it shows a balance due of $129, not $1300. We wound up going to court, and they adjusted the amount, with court costs we only owed $350 total, we didn’t fight it, so they got a judgment on us.
I set-up to make payment arrangements with them, which I didn’t fulfill, cause I knew we were filing BK. Well we were able to sneak by until Sept without them garnishing my hubby’ wages. I think they would have garnished if we owed the whole $1300 but not for a measly $350.

Hubby holds the medical insurance and he was considered the responsible party. He is down on the kids doctors as the insured/repsonsible party too. They had us both down on the summons. I wish it would have been in just my name, I'm a stay at home mom.

On our petition EVERY accont is listed as joint, I noticed that today, is that ok?
