I recently filed for Chapter 7 by my attorney's advice. However, after reading these posts, it is obvious that I will be put into a Chapter 13 if I'm lucky. I paid my attorney the fees upfront so now I'll most likely have to pay again. How much will it cost me if it is converted? Will the trustee review all of the information that I have and take into consideration when I explain the amount of expenses versus what is allowed by the IRS in my state? There not that much above except for the groceries. I pay for the groceries and feed my handicapped father. Any help you can give would be appreciated!!!!

4. Do you have any legal responsiblity to care for your father? Maybe someone could advise if you can include care for your further as an expense if he is dependent on you.

I clear 2400.00 a month and my debt is unsecured 43,000 and student loans are 12,000. I only pay rent, groceries, and other household and personal things. I live with my parents and do not pay utilities. I can't afford to live anywhere else because my credit card payments and student loan payments are 1450. a month. I had no other choice but to file because of the expected increase in credit card payments but it looks like I may be in trouble.

Scared-the student loan payments do count into your expenses. I'm guessing your monthly payment is $125 or more. (I have $11k and my payment is $125...)Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
