    Question on statements of financial affairs form number 16

    On Number 16 Of Statement Of Financial Affairs Which Is Labeled Spouses And Former Spouses.
    1. Does This Only Apply To Community Property States Or Are They Just Giving Special Instructions For Community Property States?

    2. My Lawyer Lists My Wife Who I Am Seperated From But I Live In Illinois Which Is Not A Community Property State
    3. Did I Misunderstand This Section And You List Your Spouse Here No Matter What Or Only If You Live In A Community Property State?
    4. could my lawyer of mistakingly put my wife in #16 when he shouldn/t have and what will happen

    I Am Quite Worried About Changing #16 On The Financial Affairs. Will This Be Difficult If My Meeting Is On Thursday? Am I Misunderstanding #16 Of The Statement Of Financial Affairs. Do You Always List Spouse In That Spot Even If You Don't Live In A Community Property State

      Honestly, its a minor detail that is not a big deal. The laws of the state you live in now determine if you are subject to community property or not.

      That question is to help identify a recently divorced couple in a community property state. The Trustee would be looking for assets that got divided by the divorce that may be subject to the bankruptcy code's avoidence power.

      Don't worry about it, you can always amend later.
