    Aggressive attempt to collect debt from Juniper Credit Card.

    So I got a call today from the OC collection dept for Juniper Bank.

    The guy went on and on and on, about how I am contractually obligated to pay the debt.

    He said he didnt have my attorney's name and info.

    It was pretty funny, he started saying things like you can never get credit after filing BK, and I told him that its a myth, your wrong.

    He also started saying that you have to do credit counseling before you can file a BK, I told him, your wrong again, its just a 30 to 60 minute class that you do online for $50.

    My adrenaline was pumping and my hands were shaking a little, but I kept cool, and only told him one thing, my attorney name and phone.

    Also, they called a month ago and I told them already I was filing bankruptcy and I gave them my attorney's name and phone #.

    He insisted that I must tell him more than just my attorney's name and phone number. I asked him about 10 times "would you like my attorney's name and phone number?"

    He finally gave in after 13 minutes of arguing about the topic.


    Question.

    Did the violate anything? Or are they not bound by the FDCPA?

    This is now the second time that I gave them my attorneys name and phone #.

      That's what he told me, and I told him, "go ahead and call again, I will just give you my attorney's name and phone number again".

        Why are you talking with them? I answered every call so they would not call someone else, but I just told them I am filing and hung up.

          Well, to give them my attorney name and phone number, and to show how stupid they are when they sit there and try to scare me.

          I might take you advice though.

            If you feel you must repeatedly answer the phone to talk to creditors, as they finish stating who they are, start talking - over them if necessary - calmly giving your lawyer's name and phone number, then quietly hang up even if they are in mid-sentence. Who said you have to listen or keep responding until they are done speaking? Just hang up already.

            If one of your creditors keeps calling many times a day and won't stop, consider doing what a friend of ours did. Identify yourself, give lawyer information, then put the phone down quietly on the counter and walk away. Go about your business. Return and replace phone on the receiver when the "hello?'s" and "are you there's" stop.....

            Life's too short - working on a liveable budget with the time you save not talking to creditors is a FAR better use of your time and energies.

              Agreed, I did talk over him several times and kept repeating if my attorneys name and phone number, but he was a total ass. I will take your advice and not waste any more of my time with these slum collectors.

                The collector was data mining.

                  Well, he basically data mined my middle finger, cause the only thing I told him was my attorney's name and phone #.
