Chapter 7 and rental properties

After reading some post on the forum I have some questions about the means test. Here is my situation...I have 8 properties in pre-foreclosure and about 50000 in credit card debt mostly from taking care of the properties. In a chapter 7 would I not have to pass the means test because this is considered non-consumer debt?

Also, if this is true are their any resources where I can read up more about this?

Thanks in advance.

Pooks, as long as your debt is primarily non-consumer debt than you are correct, you are not required to do the means test.

Your rentals are generally considered non-consumer debt.
You can look on the internét and do some google searches on the subject. You will find a lot of good info.

My chapter 7 was filed as a business, no asset case because of my rental properties. I did not have to worry about the means test.

Good luck to you.

"Pooks", there is a good Chapter 7 book for about $17 bucks on Nolo Press nolo.com. It is downloadable as a pdf file or in hard bound for twice the price. Very good book with all the forms in it. 'Hub
