Indigent sister-in-law, has no hope of salvaging her finances or paying a lawyer.
Basic facts:
1. Zero income, zero savings, soon to be ex-husband built the unfinished home through 70K secured loan and 40K materials on her credit card (he has no credit).
2. After the fourth incident of physical abuse she did the right thing, gained TPOs followed by a CPO. He has paid nothing in support, stopped working (except under the table) and is not supporting a 2-year and 3-year-old sons in any way.
3. She is attempting to secure a low paying job with her soon to be gained GED, and expects to lose everything at some point in the future, at least she still has her life. She is attempting to give away the dog because she can not afford dog food.
4. Emergency housing is not available; any list has a one-year waiting period.
5. I will step in and offer housing when all other options have been exhausted. I am searching for employment, have a family to support, presently tapping retirement savings, can not afford to pay for her attorney.
6. He somehow obtained through the county court, a hearing on her not signing an offer (by his friend) of 70K for the home, offered without an examination or tour of the home (fishy enough).
I have absolutely no experience with bankruptcy, understand that credit counseling organizations may hold the credit card companies interests higher than her interests, but it also appears that lawyers have an interest in helping only if they are paid up front. This is not possible. It would appear that if they could gain payment though the liquidation efforts it would be the only way to ensure everyone receives closure.
She is up the creek without a paddle, and by the way, her soon to be ex is effectively using the court system in Ohio to further victimize her. His fraudulently creative court complaint filing efforts have no basis in fact and are starting to unravel, he could be looking at some jail time real soon for knowingly filing false charges, we can hope.
She just wants out, but also wants as much of the debt paid to all creditors as possible, on the other hand, he thinks he will gain some cash, and put her and the babies on the street right before Christmas.
Any earnest suggestions would be appreciated. It took years of bad decisions for her to get into this situation, and she is learning.
