HSBC include the account in BK on credit report

    HSBC include the account in BK on credit report

    I filed Chapter 13 in early Feb. I did not include one account from HSBC as I just charged the card one day before. I don't want to be assumed of abuse. However, HSBC closed my account two weeks later. Recently I just check the credit report and HSBC had included the account in BK.

    Any idea what I should do with this account as they already included in BK although I did not

    Most all cards show as IIB on your report even if you didn't include them. It's standard practice for even accounts in good standing to be closed once you file.

        I gather this account was a zero balance account that was not included in your filing but the day before you filed you made a charge on the account? Whatever you charged on that card is your responsibility to pay as it was/is not part of your bankruptcy filing and you need to pay that bill even though they closed the account. Most zero balance cards do not survive long after filing once the creditor gets wind of the BK filing.

        HSBC is in error listing that account as being in BK and that is because you included another of their accounts in BK. As soon as you filed, they closed the other account. You need to dispute that and have that account as not listed in being in BK - HSBC should show it as being closed by credit grantor instead.

          Thank you for a quick reply. It is funny that I have two cards with them and one is still open.

            I thought you said they closed the second account...Many folks have zero balance credit cards at filing that need to be mentioned to the attorney but are not listed in the bankruptcy petition because there is no debt owing. Sometimes people get lucky and the cards remain open at least for a while and can be used but the majority get closed by the creditor, either quickly or even years down the road when least expected. Since you used that card the day before filing, that would probably fall under abuse and could not be included in your filing. In any event, it appears to now be closed and you would be responsible for whatever you charged on there the day before you filed. Ask your attorney but your attorney is going to want to know why you used that card the day before filing.
