    need help

    I have posted several times on this forum and have never seen this particular problem addressed.

    My bk was filed in Aug 2002 and discharged in Oct 2002. Then when the home that I surrendered to foreclosure was sold. This introduced about $11,500.00 in assets to my formerly no asset case. My bk was reopened 12/2002. I had already been "dumped" by my attorney as he claims he was fired by the law firm representing me and the Law firm claims they no longer wanted to handle bankruptcies. So I ended up getting an acquaintance who is an attorney to find out what was up with the reopening of my case and that is when we found out about the home sale proceeds.

    To make a very long story short, I was given an $8,000.00 check by the trustee as my "exemption" (I live in Missouri). Well then of course all my creditors got to file claims for the $3,500.00 some odd dollars that were left, all claims were denied and the trustee filed his bill for about $1,200.00 which the court has approved and he has paid himself out of those funds. There is $2,300.00 approximately left over and the trustee is getting ready to file his final report. What happens to that $2,300.00 that is left in the trustee's escrow fund that is the remainder of my estate?? I no longer have an attorney, Pacer lists me as "Pro Se" so I don't have an attorney to ask for advice (and I really can't afford an attorney right now).

    Does anyone have any suggestions about how to find out what happens to the $2,300.00? Am I allowed to file a claim for it or does the BK court absorb it?? I am just looking for some answers and guidance if anyone can help.

    Well, if the trustee has no claims to pay, and has already paid his fee, I can't think of any legal reason why that money would not be returned to you.

    But honestly, I really don't know the answer.
