Federal Student Loans are not a dischargable debt. Thanks to President Clinton.

All debts, even student loans, still have to be listed on the BK petition. Student loans go in schedule F, unsecured non-priority creditors. The bright side is the automatic stay does apply to them-and I've heard quite a few student loan lenders will give the filer 6-12 months payment deferment beyond that. Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
