    Cahpter 13 and unemployment

    I really need advise /help
    We hubby and I w/4 children have been in ch 13 for almost 2yrs now. Hubby lost his job 1 mnth ago he is currently recieving unemployment $330 a wk. We have so far been able to continue making our payments of $567.50 a wk to ch 13 but won't be able to continue this for much longer maybe 2 weeks or so. We have not spoken to our attorney (hes a real jerk, that's another story). I am wondering if we can possibly have our payments suspended or reduced if we qualify for a home affordable modification. Or are their any other options for us? The 13 includes mortgage arreage and our cars but we are only concerned at this point in avoiding loosing our home because we have 4 children.
    We don't want to continue to bust our butts to come up with the Ch 13 payments if the only option is we will end up being dismissed and loosing everything. We figure if this is the inevitable we need to use all $$'s we have to rent someplace to live.
    We are both feeling very hopeless about the situation and any advice is greatly appreciated !!!

    You really need to contact your BK attorney asap, to see if your plan can be modified.

      We were in a similar situation and we converted to a chapter 7, 341 meeting is Wednesday.

        Chapter 13's require payment even if one loses their job. We had a big clause in our Plan stating that. As soon as your hubby lost his job, you needed to contact your attorney immediately whether you thought he was a jerk or not. If your husband cannot find employment very soon, the options are to see if your Plan can be modified, your Chapter 13 dismissed or you can convert to a Chapter 7. You may not be able to save your house - your attorney can advise you after going over your situation. Best of luck to you.
