    341 Yesterday

    We had our 341 yesterday. It was like most people say - uneventful - except for a few things.

    When the trustee asked "have you transferred property in the past 5? or whatever years" - I said "yes". (We sold our house 2 years ago and bought a new one).

    My attorney tried to throw me under the bus!!!
    He said "ARE YOU SURE??? BECAUSE I WOULD HAVE ASKED YOU THAT!"
    I said, calmly. "Yes. I'm sure we sold a house 3 years ago."

    He frantically flipped through pages and said "Oh yes... here it is...we wrote that down." But apparently we were supposed to provide a closing statement - and he never asked for one.

    The trustee also said to me "So you are unemployed?" Ummmmm... No.
    (I've been employed for 20+ years without interruption and have been at my current job for 5)
    My attorney forgot to list my employment.

    Anyway - our 341 was continued but trustee said he'd take the new date off the calendar if we submitted the closing statement - which we did... so I'm wondering --- when does the 60 day count start???

    I still think our atty is a good one ... but I think he is overbooked with cases right now. He had 3 others with the same date/time as us...

    Congratulations on getting through your 341.

    Haven't filed yet, but have paid Attorney in full & will be filing 9/30/09.

    In our packet from the Attorney, he asked for all Sales & Purchases of Vehicles and homes for the last 10 yrs.

    I've been reading where Attornies have made some minor mistakes. IMHO, there are so many people filing BKs', Attornies are making these mistakes because their Case Load is so high.

    Hope providing the Closing Statement doesn't continue your Case.

      Congrats , at least you had provided info. It is usual for continuance when more documentation is desired.

      60 days starts at the first scheduled 341 even if it is continued (however they can file extensions to it if they move the 341 outside the 60 day period which does happen).
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.
