    Just filed pro-se-a couple of ?

    I have been contemplating filing for over a year and thanks to the information on this forum have finally been able to complete my forms (form7) and file my Ch7. Ok....When I filed the papers on Friday, the clerk told me that I needed a legal description of my residence that I plan on keeping. What exactly is the legal description? I recorded the permanent parcel ID# along with the street address. The NOLO book says you don't need a legal desc.
    2nd question.....After filing I realized that I had omitted a "creditor" that is actually the management company for my condo that I pay maint. fees to monthly for lawn care, snow removal, water etc. I was a little behind and got home after filing, checked my mail, and found that they filed a lien against me. How do I go about amending my schedules to include the lien? I think I have to include it even if I have to end up paying it. I am in Ohio-Northern District. Any help would be greatly appreciated

    To amend, just add the info to Form7, and there should be a place (on the same tab that you enter name, address, court that you're filing in) to mark 'amended'. The form will show an amended notation when you print it.

    Call the BK clerk, they'll be able to tell you the process for amending. (If there is a fee, if you need to do anything other than submit the amended schedules.) Regarding the legal description, again, the clerk can tell you local guidelines. Some things vary by district.
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      Hi.

      Re the legal description, Call the County Clerk and talk to someone in land records. The legal description will be a gaggle of directional words, for example: Section 15, Range 45, Township 69 in the Marcus Subdivision... blah blah blah. It could have actual directional references that surveyors would use to find the property: SE corner of the NE quadrant of Township blah blah blah.

      Or you could call a local title company in your town. They will look it up and even fax or email it to you for free. They do this as a courtesy.

      It will be on your mortgage papers, btw. And it could be on your state property tax bill as well.
