My boyfriend filed for chp13 in 2007 bec he was having a hard time keeping up with his debt. From then til now, he has been keeping up with the payments. He got a new job last Dec and since he wanted to be out of bk sooner, he started doubling his payments to the trustee. Unfortunately, they were not taking out as much money each month so he consulted his attorney to find out what he can do to pay off the debts quickly since the remaining balance was $9000. His attorney suggested that he files for a voluntary dismissal and then contact his creditors to settle his debt. He followed that advice and filed for voluntary dismissal on April 24. That proved to be a bad advice because now his creditors would not negotiate with him to settle the debt. SO now, instead of owing $9000 for his car, now they are charging him $16,000 for interest in the 2 years that he's been in chp13. By the time all this is over, he would have paid $32,000 for a car that was worth $15,000 when he leased it in 2002. He tried to reason with the car creditor and they would not budge. But that's just one creditor, there are other creditors in his ch13.
So I guess my question is:
1. There are about 7 creditors (phone bill, cable bill, computer payment, etc) that was waived bec he went in to chp13 bk and about 3 that he was paying off. Would the 7 creditors come after him now since he is out of chp13?
2. Would it be possible to file for a chapter 7 when he just got out of chapter 13?
3. Is it better to try to negotiate with the creditors than file chp7?
