We are converting to a 7 from a 13 due to a loss in dh's hours and income. The problem that I see is that we were only $500 below median on our filing date and my lawyer didn't fill out a means test so I don't have that to look at. I know he did one in February and the numbers on it showed $295 a month leftover. Obviously we don't have anywhere near that much.
So were only $500 below when we filed but we filed with April's paystubs. Dh just got May's pay and it's even less than April's. You are able to look at his checkstubs and see a pretty steady decline every month so I'm hoping that will help us.
My lawyer feels very confident that this will go through but I'm scared. He said at worst we are a borderline case and if the UST says no to the conversion then he will move on and ask the judge to overturn it.
The worst part I guess is that if this doesn't go through then we end up even deeper in debt with extra lawyer fees and still have no money left at the end of the month. Plus we are surrendering dh's truck as part of the conversion and since his pay is no longer enough to make the note we are now 1 month behind. If this doesn't go through we don't have the money to make up the note or to pay next month's note. I don't really want a repo and a bankruptcy
If for some reason this all falls through then what are our options next? Do we just wait a few more months for dh's income to keep going down further and refile or what?
I'm trying to be optimistic. My lawyer has explained everything to me and all he does is bankruptcy but everything he's told me is different from almost everything I've read here so I'm just not sure what to think.
