    Security Deposit reporting

    Where do I report the security deposit for my apartment? Do I have to notify my landlord of the BK filing if I have a perfect record paying my rent?

    I think the deposit should go on Schedule C as exempt [CA, filing using option 2]. The para legal working for my atty was going to file it on Schedule E and check "Deposits by Individuals". She said if we listed it the landlord would have to be notified of the BK. I'm not an expert, but this does not sound correct to me. Another BK atty previously told me the landlord does not have to know if my payment record is perfect with them.

    My building was recently bought by aggressive new landlords who want to evict everyone in cheaper rent controlled units. I'd rather not give them more ammunition, like a BK filing if the law does not require that they be informed.

    A deposit, if you list it at all, usually goes on your Schedule of Personal Property, and your landlord is not put on your creditor matrix (assuming your current on all rent payments).

      I'm looking at a copy of my petition now, and ours is listed under schedule C. hope this helps.

        That has to be listed? My lawyer never mentioned it.
