    Filed Ch 7 today

    State of Florida Middle District

    I filed Ch 7 today using form7 software. It was easy. My installment plan was approved. I elected to pay the full amount on or before Nov 7. My 341 meeting is 11/21. It is nice to breathe a little easier. I should have filed 3 years ago. Thanks again for all the advice!!!!

    I'm filing today as well... Was there anything you needed besides the forms and the money?

      judge changed my installment pay dates

      I got my letter about the installment plan and the Judge moved my dates forward. I said that i'd pay $70 on 11/16 and another 70 on 12/16. He has me paying $70 on 10/26 and $70 on 11/16. My problem is that I'm all spent out and I don't get paid until 10/31 which is the same date as my 341. Is there any recourse? I filed pro se.

        The payments have to be at 30 and 60 days from filing.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          I just finished all my papers and have signed and am taking them to FEDEX to send overnight for filing tomorrow!

          I also used Form7. Sooooooooo EASY!

          Good luck to all of us. I already feel better. Granted, I don't have the 341 hearing date to loom over me. And one of the people I owe is my evil big brother -- a real JERK! If not for him, I wouldn't even file. He's a gazillionaire, btw. Some people think that there is a karmic debt incurred for screwing up financially. I think my brother will have some explaining to do....karmically speaking.

            I filed on 10/4. And nowhere did I ever see anything about deadlines. I just saw that you had to have paid everything before discharge.

              All I brought to file were the forms I filled out on form7 software. I did not pay a filing fee at that time. I just submitted my request to pay it on or before Nov 7. She said that the request was approved. She gave me my receipt with my 341 date and case info.

                Got my notice

                Attorney sent me the papers for my Ch7.....filed Oct. 12, 2005. Now we wait.......and I tend to get a little impatient when I have to wait.

                  We must have crossed paths today as I filed in the same court. It sucked, I couldn't find a parking spot so I parked in a loading zone and took my chances. Then I went inside and no cell phones allowed in the building, so I went outside and hid it. Got inside and there was 15 people in line ahead of me. I thought about going back out to put the phone back in the car and repark it, but I gritted my teeth and realized this filing was the most important thing at that moment. Waited about an hour, got the filing in, and went back outside fully expecting the cell phone to be gone and car to be towed. Lo and behold, luck was with me and both cell phone and car were still there, and no parking ticket (even though I saw a meter maid making rounds as I walked to the building) ! Now I just have to worry about the courts/trustees handling of the case itself. I also used form 7. But its basically in God's hands now. And a tip to last minute filers on friday, go early in the morning and expect hours of waiting.

                    Perhaps it varies by district? I called and asked about the requirements of doing installment payments before filing. I was told 1st payment had to be $67 minimum, then 2nd payment would be due 30 days after filing and would need to be 50% of remaining balance. Final payment w/ remainder balance would be due 30 days after 2nd payment.

                    I sent in $100 in the first payment, so my 2nd was $54.50. When the clerk was keying it in, she asked why I paid that amount (because my letter said to)... I think she didn't realize I had paid an unusual amount for the 1st payment, and was thinking I hadn't brought enough.

                      To Filing On My Own,

                      I really lucked out. I got to the clerk's office around 9 a.m. I expected a long wait so I put 2 hrs worth of quarters in parking meter one street over from court house. Went upstairs one person ahead of me was almost done. Two very cordial clerks were working and I was back in my car approx 30 minutes after parking it. I was worried because I had no money to pay. But the installment forms give option for first payment to be paid on or before a certain date. I did ask that my 341 not be scheduled for 22-28 Nov. They told me that receipt prints date out automatically and that I would have to call to change it if I needed to. Lucked out again 341 date on receipt is 21 Nov.
