    341 Today

    Got there about 9:30 (was due at 10). There were several 'meeting rooms' and all seemed rather informal. I don't know if its always been in these rooms, or if perhaps they're using more rooms/trustees to handle the load. When the trustee got in, he made a few remarks about what was going to happen. He was the best dressed one in the room-not that anyone was dressed poorly just his suit was nicer than others in suits!

    The first guy called didn't have his SS card. The trustee went thru everything else, told him & his attorney he'd need to show proof of his SS# by 10-28. (I thought that was pretty nice.) The next case was over so quickly the girl hardly had time to get situated in her seat.

    The questions he asked, mainly, were if the information provided to the attorney for the petition was correct & complete, have you owned property in the pasts 5 years, do you want to reaffirm anything? He did ask more questions for those owning a home, such as when was the last mortgage taken out, how much is it worth now, is anyone else on the title, etc. He also asked extra questions to those who were married but only 1 spouse filing. The most complicated one was a man who filed alone, is still living in the house w/ his wife but the wife filed for divorce in Aug. There is likely some non-exempt equity. (Trustee was going to have someone take a look-on paper there is $36,000 equity, the man who filed was entitled to $10,000 and the house is owned w/ his soon to be X.) The trustee suggested that the man's attorney try to work out something with the wife's divorce attorney. This was the only person who was asked about income tax refund, also. I think the trustee was thinking if he could $$ from the man there, he'd leave the house alone.

    When it came out turn, the trustee had me & my DH state our name & address, and then I agreed to answer his questions. He asked if we went thru the paperwork carefully to make sure there were no mistakes or omissions. He then asked where we got the forms-I couldn't read him but it seemed odd for him to ask, maybe he was impressed as I filed Pro Se and form7.com's paperwork looks really good! He asked about DH's garnishment and if it had stopped. He pointed out that my student loans will not be discharged. (I knew that.) He asked for changes in our situation so I explained DH giving up his extra job and us deciding to surrender and go down to having only 1 vehicle. He reminded me to make all my installment payments on the filing fee, otherwise we'd have to start over. (His words.)

    We were asked more than those w/ attorneys, but it wasn't like he was grilling us. I got the impression he was trying to make sure we were aware of everything we needed to be.

    After we were done, went upstairs to pay the filing fee that was due today. The line for people filing was OUTRAGEOUS! Luckily, didn't have to wait in it to pay. The people working seemed stressed, but were trying to make the best of it.

    That's it! We were out of the parking lot in a little less than 90 minutes from arriving, and it takes a few minutes to get to & from the lot!

    I had my 341 for my chapter 13, she grilled me less than the others who had attorneys. She also knows I had worked as a bankruptcy paralegal, the only thing she questioned me about was why I have two cars and what I will do about the balloon note on my house due in the middle of my plan. The couple ahead of me with an attorney stated that they couldn't afford their first plan payment, and that they were worried about their finances. There weren't a lot of people there either. I had my creditor on my home show up and he looked more nervous than me.

          Glad its over & since we've worked out the car issues-except for getting rid of them-like we're able to move on...

          A highlight of the day-I made DH admit that filing on our own wasn't a bad idea. (He was nervous!)

              While I know that is true, I'm not worried about it. There is almost nothing that could stop our discharge-there are no recent debts and we've done nothing that might raise any red flags. And since we've worked out our transportation issues, we're not going to need to be doing anything in particular (credit wise) once we receive the discharge.

                Good job on getting other half to admit a positive. My husband has almost drove me to drink over all this. He has asked the dumbest questions (more than once too). Thank god (and I do) for this forum and the ability to be able to start over.
                StaciMM, I don't know about you but I feel so much better when I walk out to my mail box everyday and can breathe when I answer the phone. If gas wasn't so high and winter coming on (we heat with gas) we would be in a lot better position. But such is life. It is hard to save with the high prices, hope they go down soon.

                    Since you said that, I don't feel too foolish admitting that I actually look forward to getting the mail. Remember when we were younger, and getting a letter or card was a big deal? I think that always held over for me, I like getting the mail, going thru it, etc. Sure, its mostly junk but still!

                    Anyhow, I'm back to that again!

                        So glad that your 341 meeting is over, went well, and now you are "waiting" it out for discharge.
