    garnishment questions

    hubby works in the dept that does garnishments.

    A BK is supposed to stop those, right?

    How come the court doesn't send BK stuff directly to his office?

    For example, today he took garnishment out of someones paycheck like normal, but it turned out she filed last week. How was he suppsoed to know that? who is responsible for telling the payroll people?

    The creditor that is garnishing the wages should have been notified and halted the garnishment.
    The petitioner needs to get their lawyer involved now.

      Usually there is a levying officer involved, for civil, sometimes the sheriff's bureau. They have to receive notice and then in return notice the payroll office of the stay, if it all goes through the mail, there can be a little lag time.

        My husband says that 9 times out of 10, they NEVER get anything from a creditor or court, and it's the employee who has to come in with the paperwork to show him!!

          Wow, I thought they had to have a writ to garnish?

          Maybe your state is different?
