    In the process of filing 13 and my 1st wants info for loan Modification.

    I've been planning a chapter 13 for 6 months and just hired an attorney. I'm going to keep my house and pay some mortgage arrears in my plan. I was in negotiations with Wells Fargo for a loan modification but they have been dragging there feet.
    Now I received a phone call asking for a new Hardship Letter that should contain proof of income, expenses, and the reason for the hardship. I already sent them one previously.
    I pretty much gave up on this and I would have filed 13 irregardless. I was of course trying to maximize my financial position.
    How should I respond to this request? Should I give them my proposed budget advising them of the bk?
    I've read that if you tell them you are just barely making it (debt just over income) that is when they will help you...If you are underwater too much they will just foreclose or wait awhile to see if things change.
    Anybody have a successful modification before they're bk?
