    Just waiting now

Tomorrow is the last day for US TT objections.

TT declared me an asset case.

No real idea why yet although we have possible reasons.

Attorney said we just have wait to see what motion is filed.

At least theoretically I am in the 60 day club although not without a bunch of work ahead of us as we plan on fighting the TT to the end.

Oh well, at least I have lots of distracting work keeping me busy.

I also wrote to my bank today inquiring about what I need to do to start the modification process.
Very fortunate in the grand scheme of things but have learned my lesson.

    Filed 12/15/08, 341 1/12/09, Cont to 2/12/09, cont to 3/12/09, cont to 4/15/09, cont to 5/11/09, cont to 6/02/09. Discharged 9/16/09, Closed 10/23/09

If he's going after the assets of the other guy who owed you money based on fraud on that guys part and thus bk couldn't absolve the debt that could make you asset.

      Good Luck mate

Thanks, what I don't get though ( although HHM has done a great job of explaning it to me ) is if it pension money how could the TT recover it and distribute it to creditors without causing a taxable event?

THAT is what I don't get.

Another angle my attorney said we could take is that if she is going after the pension money we could negotiate part of it and have her go for it. At least she would pay the legal fees that I would have had to pay.

On the other hand she might be making an issue of preferential payments which is another story altogether. I'd negotiate that one too.

        Just gotta wait and see.
