I finally found a job, after being out of work for 9 months. This alone has improved my quality of life and frame of mind by quite a bit. I have also researched means test issues and it looks like I will still qualify for a Chapter 7....easily. But I haven't completely ruled out a 13 or a postponement of a 7 until March of 2010 in order for an issue to fall out of the 2 year look back period.

Actually, the way things stand now, if the credit card companies were willing to negotiate, I could avoid bankruptcy all together, its their insistence that I come up with thousand dollar settlements all at once that have forced me into bankruptcy and instead they will get nothing.

Anyway, just thought I'd pop in and say hey.

So glad to hear you found a job! Hope you can work with your Creditors. There is one poster in the Collections Section of this forum who settled with CA for Amex for 10% - low, man, low.

Don't forget Unless you can prove to the IRS you were insolvent on each date of settlement, you will owe Federal and State tax on the total due at time of settlement - less what you pay to settle = taxable income. Doesn't matter if they don't send you a 1099, you will have to report the amount as taxable income. If you don't report it, the IRS may audit your tax return(s). Upon completion of audit, you will owe the taxes, plus accrued penalties & interest - Waza!

The poster with Amex is paying his/her 10% settlement in payments spread for 12 months. Jeezel, I've never received an offer on any of our CC Cards and last time paid on majority was 8/08-9/08.

I wouldn't settle as we have a deficiency on a motorhome we voluntarily surrendered last Nov. and was sold at an auction in Dec. Received one letter stating date of sale & our deficiency amount end of Dec. No other correspondence or phone calls until last week, they called me. Gave them the Attorney's name & phone # & she told me to have a good day LOL!

We have an issue also. Our Attorney told us we only had to wait 1 year.So we will be filing 9/30/09. Please Update when you have time.
