    3 years in Chapter 13 and now have to relocate

    Hello everyone,

    It looks like the hammer is going to fall on my husbands job. (This fall in all likelihood). He has a lead on a job opening that looks promising in another state.

    We filed Chapter 13 in early 2006 and haven't missed a payment nor had any problems. Our house is included in the Chapter 13 plan.

    If we have to move out of state for work we will most certainly let the house go.

    How does all this work though with the Trustee? What kind of documentation would they need to transfer our case to another region in the country?

    (Currently in Michigan)

    If anyone has been through this and has any advice I would appreciate it.

    Call your lawyer and let him/her know what's going on. Discuss what options will work out best for your family in the long run - amending your plan to surrender the house or getting your trustee's permission to try and sell it before you move. The answer will depend primarily on how much equity you have in the house now and how much cash you can protect with exemptions if you are able to sell your house in today's challenging housing market.

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Thank you LRPRN. I appreciate your advice. I don't think we have any equity since property values plunged (Metro Detroit area), but my main concern is making sure that the trustee gives us enough to live on with the change in expenses (rental vs owning, higher cost of living where we're going, etc.)

      Time to give the attorney a call I think.
