    Tax return...Please help.

    Hey yall. I have a question. This morning I got a subpoena for a truck that my idiot ex husband got repo'ed. I also have a lot of other debt. I am considering filing for bankruptcy. I am very worried though that they will take my tax return that I very desperatly need. I usually get back about 5500.00 because of my kids. What can I do....I need that tax return..I CANNOT go without it. Should I go to court and get the judgement..file my taxes and then file for bankruptcy afterwards or what? I appreciate any help I can get...This is seriously stressing me out. Thanks!!

    In your divorce decree, did you make arrangements for who will be responsible for payment of the truck (not that it matters to the bank)? I'm assuming that they repoed it long ago, and are after you for the balance of the loan after it was auctioned off. Am I correct?

    If possible file your taxes ASAP before they put a lien on your return (what did the subpoena say?). Do your taxes online and have it deposited directly into your checking (quicker). But DO NOT file BK before filing taxes. The trustee will surely want your tax return.

      is there a way to file before I recieve my W2...cause my court day is Jan 14. I know I wont get it from my employer by then.

        Hmmm.... With your judgement court date so soon, I'd NOT file any taxes until afterward. I'd try to put the responsibility back into the ex's lap and plead that you are having hardships and have children to feed, and hope the issue of tax returns doesn't come up. I'm not a lawyer to be sure, so I'm just guessing. Just try to ride out the hearing as best you can, or hope the ex doesn't show up and place the burden on him.

        What was the terms in your decree about the payment responsibility?
