    how to tell if a house is in foreclosure..?

    We haven't paid in almost 5 months and my DH got a new job in a new area. We may move before our current home gets foreclosed on because the commute is killing him. So, we are looking to rent a home in the new area and I have read that some homeowners who are in foreclosure put their home up for rent and then the renters are evicted when teh house is taken over.

    How do I find out this information, it is in a neighboring state, about 50 miles away.

    I looked on "realty trac" but that didn't tell me specifics unless I joined their club or something.

    It's gotta be public record or something? Also, there is a home on my street that is in foreclosure and there is no sign, no nothing. Is this common too?

    In another of your posts you said you haven't paid since June 2009???

    All info is public record (NOD and trustee info). All a person has to do is go to the county website and either enter the owners' name or parcel number of the property and the documents pop up. Parcel numbers can easily be located on Zillow or Redfin. Also foreclosure.com gives out the street address and sometimes gives the "defendants" name (so you can search by that instead).

    There will be notices taped to the front door, but all a person (like the owner) has to do is go back to the house and take them down. My ex-neighbor would come at night and take his down!

    I hope you're not the one planning to rent out your foreclosure! ;)

      No, I am not renting out my house. In fact, we'd like to live here as long as we possibly can in order to save $.

      Yes, we haven't paid since June on our first and since April on our second. Sorry for the confusion. We just filed 13 after we thought we were going to file a 7 due to a job change but we can't move until 90 days after we finish the 341 meeting since it is to another state and our attorney isn't liscensed in that state. Sort of a mess. I have kids in school and I want to find a rental in a good area with good schools so I am starting to look now since many are a few months out in availability. I just don't want to end up in a foreclosure property so your info really helps. Thanks!

        Yep, best of luck. Odd as this sounds, I did a background check on my landlords before moving in! I've heard plenty enough horror stories so I wanted to be careful just like you do.

          Look up the official records of the county that the property is located within. Most of the time the OR's (official records) are online. In our area you find the official records on the Clerk of the County's website so you may need to search which website has the public records.

          For each property of interest 1) find out the actual recorded name on the property first. You can do this usually by looking on the county tax records by address and then 2) search the owner name on the public record website for a lis pendens or other lien recording. The advantage of doing it this way is all the records for that individual will show and you will get a very good idea if they are in trouble with that specific property and/or other properties too. BTW, you can then see the amount of the recorded mortgages and another other type of official recording - like is the person you are dealing with the actual owner of the property! Here in our area we have people that are renting out houses they don't own. So be careful. Hope this helps.
