First off, I admit I am one of those people who have not answered their phone for the last 3 months, unless the caller ID showed a name that I knew.
This week (I filed chap. 7 on 10/13) I tried answering a coulple of times, but got put on hold while they rang another number and hung up.
One co. has been calling us 4 - 8 times a day. Metris Co. Today I finally answered and waited to talk to a real person. A pleasant woman answered and using my best business voice I verified that who I was and she told me she was calling because I owed Direct Merchants a payment of $1082.
I told her that I had filed Bk and I would give her my attorneys' name.
Very politely and surprisingly pleasantly she said all right, please give me a moment to get those forms. I gave her all of the info she requested Lawyers' name, phone #, address, date filed, and chapter 7 or 13. She verified tht I was still living at the same address and simply said thank you and hung up.
Why don't I ever follow my own advice...

I know that not everyone will be that nice and that I "may" continue to get calls from the same co., but I must say that as of now, I admired the manner in which they handled this and from now on, if the phone rings, I'm going to answer it.

Glad it was a relief for you!:D

We also never answered the phone..thank god for caller ID:angel: ....I remeber the first creditor to call after we filed. Once I told them my BK info, they were SSSOOOOO nice....I was like WOW...last week you made me feel like crap....LOL

Hopefully eveythig will be easier for you now!!:yahoo:

Well, the second one went pretty much like the first, except this time the woman said "We have a program designed just for people like you, 0% interest, blah, blah, blah" I said OK, send me the info.
This particular cc Emerge was one which bought one of my lower interest cc's and raised the int. rate to 29.9%. When I called them, they said that there was nothing they could do. Now they want me to agree to pay back $9000 at 0% (and I'll bet the fine print says that they can raise the int. rate under certain situations to whatever they want).
Excuuuuse me!!! I may have been born at night, but it wasn't last night. :D

I have had Citibank offer the same thing. But they do say (Here's the kicker) if you drop out of the plan ( 1 year) they go back to the beginnig and add back all previously witheld fees and such...:blink:

BEWARE!!!!
Cause in the "fine print" IF YOU AGREE - you agree to pay back anything that you owe them. The "kicker" is your AGREEING TOO they are NOT ASKING YOU TOO!!
Watch out for that one!!!!

Thanks Minny, I will be looking. I was told "We have many options" I said "Great! Send them to me!" Dead pause of 5 seconds..."Well, I have them in front of me"..."Great! But I want them in front of ME!" So, I'm waiting...:P

Man, discharge it all as far as unsecured debt. Don't play with these folks. If you are gonna' BK, dump it all.

Update...I've now dealt with 5 collection calls on the phone and all went very smoothly and pleasantly. The number of calls has reduced dramatically and we are no longer living in panic everytime that the phone rings.
Some only asked for the lawyer's name and phone number.
Living with less fear is a wonderful thing! Art

Isin't it funny? They get nasty as a wet hen, when trying to get money, but say "Oh I filed BK" and holy moley! Suddenly they are 5" thick of frosting on a cake! :blink:

i'm glad that it's going well for you... we just had to file a complaint with the FTC about 2 different creditors continuing to call and harass us. Not sure if the complaint will do any good or not, but you never can tell.

I used to stress about being in debt, not anymore..
I dont answer my phone anymore either, maybe thats
why i dont strees :) no matter how many times i tell these
fools I have no money, no job, they keep trying to call,
whatever, i just disconnected my phone, and got a cell
to make my calls.

although, sad to say, ive ignored the new BK law, ive had plenty of time to do it, i guess just putting it off and being lazy, I guess I will see what happens when i do file, if i can, some make it out that I wont be able to now...

I have to think about that one, if the debt was charged off in BK, then dismissed, then really there is nothing to pay back., so they are asking you to pay $0 back? because when bk is over that is what your balance should be....

i disagree, if you have a credit card that may not have much on it, why not keep it, as long as you keep it current, it will help your credit build faster, I would think, no expect here.

Sorry Davids, but you cannot "Pick and Choose" the unsecured debt you will or won't keep.

Rules (As stupid as they may seem) are rules :blush2:

Davids-Geneco is right. When you file, you're required to list every debt. The creditor will be notified of the BK, and account closed. If you have a $0 balance card that isn't listed, there is still a good chance the card will be closed when the creditor does a periodic review.
