    Cosigner/keeping the auto loan

    My car was in the process of dying a spectacular death and I had to trade it yesterday. However, in order to get the loan, my mom had to co-sign on it. She gets the paperwork, I get the payments.

    I was planning on filing Chapter 7 next year after my divorce is final, and plan to reaffirm the loan and keep on paying as usual, with the eventual goal to refinance through my credit union in my name only. (The car is titled to me.)

    Will my chapter 7 affect her, or is it just something she'd have to dispute if it popped up.

    If the car loan is still active when you file, since your mom is a co-signer, she will have to be listed on your bankruptcy forms when you file since she holds a financial interest in the car.

    You are filing bankruptcy, not your mom. It shouldn't affect her at all. If something does show up on her credit report by mistake, all she has to do is dispute it - it will be removed quickly.
