    What is likely to happen in court.

    I have a courtdate with chase on Nov 5th in NYC. I answered the summons in person to the clerk, explaining I plan on filing Bankrupcy but haven't retained a laywer yet.

    I probably, but not necessarily, will not have a BK filing before the trial date so I was wondering what the Judge will likely do...set another trial date to give me more time, simply rule against me and if he does, then will he order a garnishment?

    Anyone have any idea on the likely scenario?

    Generally when you answer a summons, you have to pay to file the answer. This procedure is not generally made clear. Did you pay to file the answer?

    If you file before the court date, your lawyer will handle it. At that time, the issue has no importance. Just tell your lawyer and enjoy the bankruptcy 'stay'.

      BigJohn: I didn't have to pay to answer the summons. I went to the court in person and the clerk took care of everythng. He was very helpful.

      Most likely I woll not have filed before the court date (saving up money for the laywer) so I'm curious what the court will do.
