    Trustee Payments

    I need some serious advice because I am now 4 months behind on paying my trustee. This all occured because I've been out of work because my baby daughter had to have open heart surgery. Also, we have racked up $2700 in my hubby's corp AMEX card (pratically living off of it) and now we are $5K in debt. Everyday seems to get worse because I think about the trustee filing a motion to lift which means we will lose our home.

    We have worked so hard at keeping our home and that is the only reason why we filed for bankruptcy because Chase would not work with us. It has been a hard 4 years because my husband and I both lost our jobs the same day, we have a special needs child that required a lot of medical attention and of course our income has dropped from over $100K to $60K.

    Please let me know if there is anything I can do about getting the trustee back on track?

    contact your lawyer asap!!!! let him know what is going on. Let the trustee know what is going on. Plans can be modified if need be or you can dismiss and refile but not if the stay is lifted. Then you will have to wait 6 months and your home will be gone!! good luck

      Contact your, or an, attorney ASAP. Payment Plans can be amended and if the situation warrants you can convert to a chapter 7. If your case is dismissed, none of your debts listed in the Chapter 13 will be discharged and in many circumstances, become non-discharable even in a subsequent BK.

        From my own experience having been in the same situation, once I was behind going on my 4th payment, a motion to dismiss my Chapter 13 was filed. I had to come up with all 4 payments and give the cashiers check to my attorney to appear in court to ask for a stay and present my check. My mnthly payment amount was $2119, so I had to come up with $8,476. It wasnt easy. I definitely would advice you to call you attorney ASAP and get him/her to help you out. They know all the tricks.
