We spoke with an attorney this week and have decided to file chapter 13. We have been paying our mortgage on time, and have recently been approved for a modification through the government. The attorney said that when we file 13, our mortgage will also have to be sent to the trustee in addition to anything else they include for our unsecured debt. We worry that they may decide we cannot keep our home or that paying them puts them in control of our mortgage. Can someone tell me how this works or at least reassure us that we will not lose our home if we file? Can filing a 13 effect the amount we pay each month for our mortgage?

Please review the Chapter 13 "Stickys" in this forum. You need to educate yourself a bit on Chapter 13. If you are eligible to file Chapter 13 you will not lose your home and you more than likely will be able to continue to pay your mortgage outside of the Plan. Yes, your mortgage will be part of your Chapter 13 filing as all debts are included, secured or unsecured._________________________________________
