    Failed Notification of Creditors 341

    I'm wondering about something. Most if not all of my debts have been bought by other parties now so the original creditor is no longer the banks we all know by name. I've also moved residences since my downward spiral has begun.

    Question: So what if certain creditors are not notified of the 341 meeting? I mean by now I don't know who they even are, I just listed the most up to date info I had to my incompetent lawyer? I assume he has notified all of them for the meeting. What I don't want to happen is have some unknown creditor claim that he was not notified properly of the meeting and refuse to discharge the debt.

    Generally, what you do is list the original creditors (owners) of your debts and anything that might be on your credit report at the time you file. At that point you are doing the best you can. You cannot be expected to keep track of every time a debt is sold or resold.

    If by chance, you remember something you forgot, you can amend your schedules. It is no big deal and you pay around $26.00 to amend your petition/schedules, whether it is for one creditor or more.

    Do NOT worry about the 341. 99% of the time, no representative shows. After all is said and done, you will wonder why you worried. Search here on '341', and you will see. The 1% of the time that a rep shows, there are other matters like an ugly divorce, ugly dissolution of partnerships--things of that nature. CCs and loans rarely show.

      i pulled credit reports for my husband and myself- and listed everyone on it. On the mailing matrix i also included the CA's that i had papers from.

      That's really all you can be expected to do.

      Most places are looking at your credit anyway; and will see that a BK was filed.
