    Help me

    I filed a petition for a Chapter 13 Bankruptcy but am not going to proceed with it. What do I need to do to dismiss the case? I assume there is a form that needs to be filed. Where would I find this form? Thanks in advance.

      Chapter 13

      Hello everyone,

      I have been reading about some of your questions concerning Chap 13 and I have a question of my own.

      I filed a Chapter 13 in about June of 2002 but when it came to court in Sept2002 I was not willing to sell my Rental Properties and had the Judge to dismiss the Chap 13.

      I never started a payment plan, but my creditors posted the Chap 13 on my Credit Reports and those posts are still there, although i did find a Bank that would refinance some of my property and paid off all of my Creditors with "Settlement" amounts and those settlement amounts are reflected on my Reports.

      My problem and questions are these

      #1. Can my Chap 13 be removed from my reports?
      #2. How long does a Chap 13 stay on my Reports?
      #3. Chap 13 cases remain open as long as the Plan Payments are being made,
      generally 3-5 years after the Plan has been confirmed.
      " If the Plan was never confirmed shouldn't I be able to remove the
      Chap 13 NOW??"
      #4. By Dismissing the Chap 13 and not even using the Chap 13 process
      wouldn't my case already be closed and removed? Especially since I paid
      all of my Creditors?
      Please help me understand or at least learn how to remove the Chap 13 entries from my Credit Reports.
