Well, well, well....received a call from Zwicker & Assoc.

Got a voicemail on Saturday from this bunch. I don't know who it's for yet as I haven't talked to them. I'm going to wait for a letter and then DV. I don't know when I'll be filing yet, more than likely next spring. We've just got soooooo much going on right now. I know these are bottom feeders - anyone else have experience with them recently? I found a couple of threads from last year.

Oh yeah we have had experience with them. They lay on the whole "we are a LAW FIRM" bit... designed to sound like they are going to sue you in a minute if you don't pay.

Call them back, confirm their mailing address and tell them you will be sending a DV letter including a request for no further contact by telephone at work, home or any manner whatsoever, in writing only.

You will probably never hear from them again. If they can't harass you they generally can't collect ie: won't waste any more time on you.

Don't worry if they threaten you. Just hang up.

They do a lot of work for Amex. Google them...nasty and a reputation for suing, but they lie an awful lot. Amex sent our account to them once but we called and got it pulled back (they have an office about 50 miles from us so it would have been toooo easy for them to sue us).

I don't have an Amex account. I'm thinking it's for HSBC. They have yet to send me a letter and I will NOT answer their calls. I'm too emotional right now as I am 36 weeks pregnant. I'm afraid they may be able to get to me and make me say something I'll regret. I wish they'd just send me a letter so I can DV them.

Funny you should start this topic. I just checked my home voicemail call log, saw a # i did not recgonize, so i googled it. sure enough, it's Zwicker. not sure what card, i'll run my voicemail tonight, but they left a 45 second message

Yeah, it's a stupid message. They won't say anything but "This is a message for XXXXXXX. If this is not XXXXXXX you have three seconds to hang up. Blah, blah, blah and to call them regarding an important business matter"

I just checked the docket for my district and they have 3 lawsuits in my state - 1 in my city. I googled them and they also have an office right in my city - this doesn't look good. But, if they decide to sue, I have nothing that wouldn't be exempt anyway.

yeah, i just checked my court docket, the only thing I found was someone sueing them.

Ha, ha! When I read this, I went back to the site and checked and it is THEM who is being sued! I just glanced over it before. They are the defendant in a FDCPA suit. The other two cases in my state are the same - they are the defendant. This might not be so bad after all!

I have a theory about this though. I have checked several law firms/C'a's with the same result. I think they file the suit under the name of the original creditor, so it makes it difficult to tell how many of these firms are actually filing.

Ohh these Azzhats are ruthless. They just called my home phone, mother-in-laws, and my Cell # within a span of 5 minutes, starting at 6:30 am. just send me your first contact letter dammitt so i can DV.

Nice. I'm still waiting for a letter so I can DV them. They call twice a day, but don't always leave a message. All my cards but one are with a CA now. Let the "fun" begin!

I swear, there outta be more laws protecting consumers against these sharks. I cannot believe they get away with what they do.

Could you imagine doing that for a living? Could not imagine you would go home every day feeling good about your day.

Yeah, I had them for one of my cc accounts too (I think it was my AMEX acct). Anyway, they are relentless, they will call, threaten and bug the heck out of you!! I never picked up the phone, but I would listen their messages :D One message at the begining did have me a little scared (male voice)...it went something like this: "Okay, Ms. Liz417, the GAME IS UP, YOU NEED TO CALL ME @ xxxxxx by 8pm tonight, I will be waiting for your call...if you decide NOT to return my call, I will have no other choice but to file the paperwork I have in front of me with the courthouse on Feb. 2nd (which was that Monday). We are done with your games and want to speak with you personally!"
I ignored the call....went another year without paying...nothing happened :D

OMG.. what scum bags. I DV'd them and we never heard from them again.

The truth us they cannot sue everyone, it costs on average $900 just to file suit in my county. When taken into account the collections agency work, attorney's time reviewing account, preparing suit papers, legal secretary going to courthouse and filing, filing costs, etc. They want to make sure they can get their investment back.

AND they count on the fact that most people don't answer the suit, and they win a default judgement. I would answer, right before the 30 days is up...

great story Liz. calling my Mother-in-law who lives in the back house is what pisses me off. she knows what is going on, and she just told them she doesn't know us.

ROTFL! The "game" is up? What game would that be? The game where I HAVE NO JOB? What a bunch of tools! And how funny that you went another year without paying! Thanks for the story!

got a new letter from them today. now they have 2 accounts. it's a Kohl's/Chase. Interesting, since I DV'd the first CA that had this account, LC Systems, about 3 weeks ago.

Funny how that works. You DV a CA, then they cant harass you by phone, so they send it on to a new tougher one. I'll bet this is the one they called on so early this morning.

Upon your written notification within such thirty day period that this debt,or any portion thereof, is disputed this office shall obtain verification of the debt or a copy of judgment, if any, against you and mail you a copy of such verification or judgment. ........Please contact so and so, one of our non-attorney account mgr.....

What should I do send a DV? Or retained my lawyer and start the BK7 process?

I'm just going to send a DV. But if I were you, I would get my ducks lined up ro file. i have been Planning my BK for a year now

I got my letter yesterday, too! It's the same thing here. I thought it must be for HSBC and it turns out that it's for a Chase account that I already DV'd , just like you. Two collection agencies in a month. Wonder what they will do when I DV this one?

The first CA was Integrity Financial - now isn't that a hoot? A collection agency named "Integrity"!

This is just a typical collection dunning letter. They all say the same thing. Go ahead and DV them.

Do you know where I can get a sample DV letter? I have no experience in writing this type of letter.

Just google "sample debt validation letter" and you will get plenty of examples from very simple to very complex.

Oh, Zwicker! I have had trouble with them in the past. I usually don't send my cease and desist letters by certified mail, but with them, I advise it anyways. They ignored the first letter I sent by regular mail, but they stopped calling and I never heard from them again after they got my certified letter.

I will up you all one. Zwicker just filed suit against me. Using local attorney. Should be an interesting fight. I searched for the attorneys name online in my county and many of the suits are dismissed for lack of service. Seems that can't find their defendants LOL. :clapping:

I received a summons also. I have a few more days to respond. I don't know if it is worth it or not to respond.

I have no idea where this is going, except that I do not want to file until after Feb 1st due to a mortgage modification I am in the middle of...
