    First time consulting a lawyer

    Wife and I have a home based daycare business that has lost much of our only income, but I anticipate income going back up in the next 6-9 months.When our income goes back up, I will be able to pay bills, without credit cards, but till then I need credit cards to get by.We are for sure gonna file BK at some point...we are in our 50s and have 50k cc debt,64k mortgage,and car payment.
    I have many questions I would like to ask a lawyer but its gonna be several months till I want to file. In the meantime, I will still need to use credit cards for survival. At what point would a lawyer visit be the "timeline in history" visit that would be a red flag for fraud for using credit cards after consulting a lawyer?

    At no time would any visit to an attorney throw up red flags. The date you file is when the clock starts. We went a year and half from our initial visit to the day we filed.

    What will matter is the six months prior to the date you file. So if you are planning to file, you need to start planning for it now. You need to stop using the CCs, and stop making payments to them--save that money for your attorney. If you have made any large purchases, cash advances, or paid someone back a large sum of money ($600.00+) during the six months prior to filing, you need to let those age out before filing or you could have trouble.
